FCC Commissioner Anna Gomez characterized ABC’s decision as a surrender that endangers the right to free expression and urged collective defense of the First Amendment. Gomez, the sole Democratic appointee on the commission, criticized FCC Chairman Brendan Carr for suggesting broadcast licenses might be at stake. Carr had told a podcaster that Disney faced a serious issue and that the FCC might take further action. Gomez asserted the FCC lacks constitutional authority to police content or punish broadcasters for speech.
