DOJ Sues California Over In-State Tuition for Noncitizens
"California is illegally discriminating against American students and families by offering exclusive tuition benefits for non-citizens,"
"The DOJ will "continue bringing litigation against California until the state ceases its flagrant disregard for federal law.""
"The DOJ has now filed three meritless, politically motivated lawsuits against California in a single week,"
The Department of Justice filed a lawsuit in the Eastern District of California challenging state provisions that permit undocumented students to pay in-state tuition and access state financial aid under the California Dream Act. The complaint names the state, Governor Gavin Newsom, the attorney general, and the governing boards of the University of California, California State University and California Community Colleges. California hosts over 102,000 undocumented students who have been eligible for in-state tuition since 2001 and state financial aid for more than a decade. State officials vowed to fight the lawsuit and called the federal actions politically motivated.
