Currie, a Clinton appointee, based the dismissal on the grounds that Halligan, the sole prosecutor who presented the case to the grand jury, was unlawfully appointed."
A judge dismissed the Department of Justice's prosecution of former FBI Director James Comey after finding the presenting prosecutor was unlawfully appointed. The indictment had charged Comey with making a false statement to Congress and obstruction of a congressional proceeding. Comey's attorneys challenged the case as improper, malicious, and disparate treatment compared with similarly situated individuals. Revelations showed the full grand jury never saw the complete indictment. The dismissal was entered without prejudice, but the statute of limitations expired on Sept. 30, leaving no legitimate basis to refile the charges.
