Legal challenges have called the authority for broad U.S. import tariffs into question. A federal appeals court ruled that invoking the International Emergency Economic Powers Act of 1977 to justify tariffs exceeded presidential authority and upheld a New York trade court decision. The administration asked the Supreme Court to review the ruling and requested a decision on whether to hear the case by Sept. 10. The tariffs had been presented as tools to deter illegal migration and fentanyl flows and to incentivize domestic manufacturing. Trade agreements with partners such as South Korea and the European Union were tied to tariff leverage and could be unwound if courts overturn the policy.
