Two witnesses provided sworn affidavits saying Alex Pretti, a 37-year-old intensive care nurse, was not brandishing a weapon when he approached federal agents in Minneapolis. The affidavits were filed in federal court in Minnesota hours after the killing as part of an ACLU lawsuit on behalf of Minneapolis protesters against Kristi Noem and other homeland security officials. One witness filmed the fatal shooting and identified herself as a children's entertainer; the other witness is a nearby physician who said federal officers initially prevented medical aid. Witnesses described Pretti being tackled after aiding another observer and said they saw no gun.
