N.J. company sues borough for denying proposed 60-foot-high billboard
""The Board's denial is arbitrary, capricious, unreasonable, unconstitutional, unsupported by substantial evidence, and must be reversed," said the complaint."
""failed to apply the law as it existed""
IAAT Services filed a complaint in Somerset County Superior Court on Dec. 15 seeking reversal of the Raritan Borough Planning Board's November denial of a double-faced digital advertising sign on Route 202. The proposed billboard would rise 62 feet with a 48-by-14-foot digital screen at the corner of Route 202 and Second Avenue. The company says it met land-use criteria and obtained required state and federal permits and variances. The complaint alleges the board denied the proposal due to public concerns and misapplied a borough-wide ban outside its intended zone. The complaint notes the borough updated outdoor advertising rules after the denial.
