"There was insufficient evidence of willful, deliberate, and premeditated murder or a specific intent to kill."
Antolin Garcia-Torres was convicted in 2017 and sentenced to life without parole for the kidnapping and killing of Morgan Hill teenager Sierra Lamar in 2012. The California Court of Appeals reversed this judgment on Friday, determining there was insufficient evidence to support charges of willful, deliberate, and premeditated murder or specific intent to kill. The prosecution is now barred from using these theories in any retrial. Garcia-Torres may receive a new trial as a result of this appellate decision.
