Seamus Culleton has been detained by US Immigration and Customs Enforcement (ICE) since September and describes the detention facility conditions as "horrible" and comparable to a "modern-day concentration camp." Culleton is originally from Co Kilkenny, has lived in the US for almost twenty years, and is married to an American citizen. He was detained on 9 September in Massachusetts while driving home after work and taken to an ICE facility in El Paso, Texas, despite holding a work permit. The Department of Homeland Security states he arrived in 2009 under the visa waiver programme and did not leave after 90 days. His lawyer has challenged the lawfulness of the detention citing due-process violations and notes procedural protections and notice requirements for VWP entrants. The lawyer also noted historical exemptions for immediate relatives of US citizens. His wife described the process as overwhelming and said life has been on hold for months while she wants him home.
