Carlos Sebastian Zapata Rivera was driving his wife, Juliana Milena Ojeda Montoya, and their 1-year-old daughter when Immigration and Customs Enforcement agents pulled the car over to arrest Ojeda Montoya. During the arrest, an unidentified Department of Homeland Security agent allegedly climbed into the vehicle and choked Zapata Rivera, producing involuntary, seizure-like movements and rendering him unconscious. The lawsuit alleges the agent used a chokehold, also called a carotid restraint, which is considered deadly force. DHS accused Zapata Rivera of "faking a seizure" and allegedly claimed he refused medical attention while an agent "waved EMS away and told them, 'He's all good.'" The ACLU of Massachusetts represents Zapata Rivera and contends the force was excessive and unlawful; Ojeda Montoya was transferred to Maine and later ordered released.
