Eight Democrats Vote to Confirm Judicial Nominee Who Refused To Say Trump Lost 2020 Election

Eight Senate Democrats voted to confirm Sheria Akins Clarke as a judge for the District of South Carolina by a 52-38 margin, with 10 senators not voting. At a March confirmation hearing, Sen. Richard Blumenthal asked Clarke and other Trump judicial nominees about the 2020 election and the January 6, 2021 Capitol riot. Clarke did not answer questions about who won the 2020 election and instead referenced the constitutional mechanism for electing a president. Blumenthal criticized the nominees for refusing to provide basic answers and for allegedly subverting the Constitution and lacking independence. The refusal was not disqualifying for the eight Democrats who supported confirmation.

Clarke's response or lack thereof was not disqualifying as far as eight Democratic senators were concerned on Tuesday."

In numerous confirmation hearings, Democratic senators have asked many of the president's nominees about the 2020 election and related questions, which the nominees have refused to answer."
