The Equality and Human Rights Commission (EHRC) addressed concerns regarding transgender rights in the workplace after a recent supreme court ruling limited the definition of 'woman' to biological women. Chair Baroness Kishwer Falkner emphasized the importance of distinguishing between legal rights and personal preferences while assuring that trans rights would be legally protected. New guidance is being developed to address how to respectfully inquire about gender status while safeguarding privacy and dignity, though it is acknowledged that certain privacy rights may not apply in all scenarios.
Baroness Kishwer Falkner stated, 'We protect their rights under the law as they exist, and we also have done so and will continue to do so.'
John Kirkpatrick emphasized the need for appropriate guidance, saying the EHRC hopes to address how questions can be asked while respecting privacy and dignity.
