The victims and courts bill would strip parental responsibility from parents convicted of serious sexual offences against children and sentenced to four or more years imprisonment. However, the legislation contains a significant gap: it does not protect children born after the offender's release from prison. Crossbench peer James Meston has tabled an amendment to close this loophole, arguing that offenders could have additional children who would remain unprotected. The government previously stated it cannot bind future children but that family courts retain authority to strip parental rights if needed. Meston contends his amendment overcomes human rights concerns while ensuring comprehensive child protection across all siblings.
