Education secretary Bridget Phillipson was unable to give a clear position on which toilets trans women should use after a Supreme Court ruling. The Supreme Court ruled in FWS v Scottish Ministers that, for the 2010 Equality Act, sex means biological sex. The Equality and Human Rights Commission consulted on a 300-page code of practice that could restrict trans access to single-sex services. Interim EHRC guidance briefly included a clause that would bar trans women from both men's and women's toilets; that guidance has been repealed.
