Bernie Ecclestone suggested in 2023 that sport executives were aware of the Crashgate cover-up before the 2008 season ended. The FIA, Ecclestone and Formula One Management deny the allegations and asked the London court to dismiss the case, arguing poor performance at Singapore and delay. Mr Justice Jay ruled Massa lacks a real prospect of obtaining declaratory relief but has a real prospect of proving unlawful means conspiracy and inducement at trial.
