Target Corp., Whole Foods Market and Walmart Inc. will be added as defendants in lawsuits against ByHeart for selling a product potentially contaminated with spores that cause infant botulism. A foodborne-illness attorney representing affected families plans to add the grocery chains to the lawsuits and says ByHeart likely is insolvent and may go bankrupt, urging retailers that sold infant formula to help families. The CDC reported 51 babies given ByHeart formula over two years have been hospitalized with infant botulism; none have died. Health agencies are investigating the cause. The FDA sent letters directing Target and Walmart to improve removal of recalled products after ByHeart recalled its formula on Nov. 11. Walmart reported issuing a sales restriction on Nov. 11 and no sales after.
