Raising the Stakes: New gambling advertising rules in Ireland
"The new Gambling Regulation Act 2024 (" GRA ") signifies a major change to the law on betting and gambling in Ireland. Replacing legislation that is nearly 70 years old, the GRA has been described by the Irish government as "historic". It is being implemented on a phased basis and key features include: Establishing the Gambling Regulatory Authority of Ireland ("GRAI") to licence, supervise and control gambling activities in Ireland."

Changes Ahead in marketing gambling servicesCurrently, rules on advertising of gambling services are primarily set by Ireland's Advertising Standard Authority's (" ASA") Code of Standards for Advertising and Marketing Communications (the " Code "). The ASA is a self-regulatory body for advertisers in Ireland and the Code is non-statutory. While the Code is not legally enforceable, advertisers agree to abide by it and marketing communications that are found by the ASA to contravene the Code must be amended or withdrawn."
The Gambling Regulation Act 2024 replaces nearly 70-year-old law and creates the Gambling Regulatory Authority of Ireland (GRAI) to licence, supervise and control gambling activities. A new licensing model covers B2C licences for operators, B2B licences for suppliers and advertisers, and licences for charitable or philanthropic gambling. The GRAI has opened applications for B2C licences and intends to phase in the other licence categories later. The GRAI will have powers to impose and enforce obligations on licensees regarding advertising, sponsorship and inducements. Current advertising rules are set by the non-statutory ASA Code; the ASA will continue handling complaints and will cooperate with the GRAI. The Government frames the GRA as a public health measure.
