The Alameda County District Attorney's office has dismissed charges against Radius Recycling, a metal crushing plant, for insufficient evidence related to a 2023 fire that released toxic smoke. The decision concludes a prominent case previously publicized by former DA Pamela Price, who highlighted the company's history of environmental violations. Notably, a judge's recent recusal of several prosecutors did not influence this decision, according to the current DA's office, which reaffirmed challenges in proving the case. The dismissal means Radius avoids potential fines up to $33 million.
On Tuesday, a spokesperson for Jones Dickson said the decision had little to do with the judge's recusal order, but rather the office's ability to prove the case at trial.
We believe that Radius has often shrugged off the regulations when it was convenient to them, treating minor administrative fines and civil penalties a cost of doing business.
