In 2024 the Department of Sanitation implemented a containerization mandate requiring buildings to use bins instead of bags to reduce pests and litter and improve quality of life. The rules apply to properties with one to nine residential units and to special-use buildings receiving DSNY collection, including city agencies, nonprofits, houses of worship, and professional offices in residential buildings. Penalties begin at $50 for a first offense and increase to $100 and $200 for subsequent violations. A bill to be introduced on Oct. 29 would create a waiver process for small mixed-use buildings that lack legal or safe space for trash bins. Under the proposal DSNY would have 60 days to review applications, would create an online portal, allow appeals through OATH, require DSNY-issued stickers for waived buildings, and mandate agency outreach to inform owners and tenants.
