Appeals court sides with Democrats in case to redraw Malliotakis' seat
"I look forward to the Supreme Court's intervention in this case to uphold the rule of law"
"New York's appellate judges had a duty to step in and press the pause button on such a clearly unconstitutional decision. The U.S. Supreme Court has been unequivocal: race-based redistricting violates the U.S. Constitution."
A state appeals court unanimously ordered the New York Independent Redistricting Commission to redraw the 11th Congressional District, which covers Staten Island and part of Brooklyn. The ruling sided with Democrats seeking map changes, though Republicans are appealing to the U.S. Supreme Court. Justice Sonia Sotomayor directed Democrats to respond to the Republicans' appeal by Thursday. The proposed changes could turn a safe Republican seat into a competitive district by merging Staten Island with Lower Manhattan. Representative Nicole Malliotakis said she looks forward to Supreme Court intervention and argued that race-based redistricting violates the U.S. Constitution. Governor Kathy Hochul called for work to begin on redrawing the district to ensure fair representation.
