Arrest records show McPhatter was taken into custody on Tuesday and released without bail. His next court appearance is scheduled for Wednesday, March 25, 2026."

Court filings allege in August he opened a patrol car door near a civilian, sprayed pepper spray toward the ground, and pushed a person inside a precinct lobby after refusing to provide his badge number. Prosecutors allege in October a 60-year-old trespass suspect was handcuffed, berated, slammed against a patrol car twice and slapped, then treated at a hospital and released. The NYC Civilian Complaint Review Board lists more than 20 allegations against McPhatter. McPhatter was released without bail and faces a March 25, 2026 court date; the Brooklyn District Attorney said the office will seek accountability.
