Michael O'Toole (28) and Martin O'Toole (61) appeared charged with theft, with Michael also charged with a public order offence. A truckload of gravel was delivered on January 28, 2025, to Church Lane, Newcastle, Co Wicklow, and unloaded in a lay-by used for more than 20 years. Ed Power had arranged and paid for the gravel for maintenance on his home and later saw Michael operating a tractor and Martin holding a shovel while the gravel was being moved. Michael told Power, "It's my gravel; I can do whatever I want with it." Power's wife said she feared being hit and left the scene. Defence counsel described the lane as uneven and full of potholes, and the defendants believed they were entitled to spread material if it lay on their land. Retired garda Sean Carroll attended and was told by Martin that he had an agreement with An Bord Pleanála.
