
Drip Coffee, a single independent coffee shop in Fort Lauderdale, filed a lawsuit claiming it was fraudulently induced to sign a lease for a shopping center scheduled for major redevelopment. The operating company, Sheer Hospitality, LLC, sued Kimco Realty and a Kimco-affiliated ownership entity for the Cypress Creek Station shopping center near I-95. After a buildout, Drip Coffee opened in September 2025 and later closed. The owner accused Kimco of using the business as a “pawn” to generate short-term rent while redevelopment plans would affect more than 100,000 square feet to make way for a Target store. The suit seeks $9 million in damages and cites construction and demolition beginning shortly after opening.

"Alleging the landlord began major construction and demolition work shortly after Drip Coffee opened, the suit seeks $9 million in damages, according to a report from The Real Deal. Public planning records reviewed by DCN show that the Kimco affiliate known as Cypress Creek Associates LP submitted a site plan for the proposed Target at Cypress Creek Station on Nov. 11, 2024, following a preliminary planning meeting on Oct. 25, 2024."
"A spokesperson for the company told The Real Deal that Kimco disagreed with “the characterization of events and allegations.” DCN reached out to Kimco Realty, a New York Stock Exchange-listed company headquartered in Jericho, New York, for comment on the allegations but has not yet heard back."
