"During the pending hearing, Williams may decide if Torres-Mendoza should be placed in MHM Services Inc. - which provides mental health services to government agencies and which operates a secure facility in Vallejo - or one of five State Hospitals in California. Criminal charges have been suspended against Torres-Mendoza under Penal Code section 1368, which stipulates that a defendant in a criminal case cannot be tried or punished if they are mentally incompetent."
"Reversing her March decision, a Solano County Superior Court Janice M. Williams in May ruled that Brandon Torres-Mendoza was incompetent to stand trial. He faced a mental health facility placement hearing and a report from the North Bay Regional Center on Monday, but the judge, acknowledging a defense request to continue the matter, reset the hearing and report for 8:30 a.m. Sept. 23 in Department 23 in the Justice Center in Fairfield."
Brandon Torres-Mendoza, 24, charged with stabbings on an Amtrak train last year, was ruled mentally incompetent to stand trial by Solano County Superior Court Judge Janice M. Williams in May. A placement hearing and a report from the North Bay Regional Center were scheduled and then reset for 8:30 a.m. Sept. 23 in Department 23 in Fairfield. Defense counsel Matthew Adler and Deputy District Attorney Gerald J. Hall appeared in court. A psychologist’s new report prompted suspension of criminal proceedings, and the court may order placement at MHM Services Inc. or one of five State Hospitals. Charges remain suspended under Penal Code section 1368 but can be reinstated if competency is restored.
