She had previously pleaded guilty to a second charge that she wilfully neglected Mr Davies between September 5 and September 9 that year by failing to disclose she had wrongfully administered morphine. At Gloucester Crown Court on Monday, she was spared a custodial sentence and ordered to carry out 100 hours of unpaid work."
Jane Barnard, 67, mistakenly administered medication prescribed for another resident, including 90mg of slow-release morphine, to Derek Davies, 75, who died on September 8, 2021. Barnard denied killing Davies and was acquitted of manslaughter by a jury at Gloucester Crown Court. She pleaded guilty to wilful neglect for failing to disclose the wrongful administration and for breaches between September 5 and September 9, 2021. Controlled drugs had been stored incorrectly in a bathroom cabinet instead of the designated locked room requiring two staff checks. Barnard failed to follow procedure, was suspended, and was ordered to carry out 100 hours of unpaid work.
