Kneecap rapper will not face new terror trial after CPS appeal rejected
"The respondent has not been tried for his alleged conduct on 21 September 2025 and will not be tried. He has not been convicted, and he has not been acquitted. Lord Justice Edis, sitting with Mr Justice Linden, said the judge was right to hold that he had no jurisdiction to try any summary-only offence alleged to have been committed on that date."
"Chief magistrate Paul Goldspring ruled the proceedings were instituted unlawfully. The Crown Prosecution Service appealed the decision at the High Court at a hearing in January, with the Kneecap rapper opposing that appeal. On Wednesday, two judges at the High Court upheld the decision and dismissed the CPS appeal."
Kneecap rapper Liam Og O hAnnaidh, performing under the stage name Mo Chara, will not face a new terror trial after High Court judges dismissed the Crown Prosecution Service's appeal. He was accused of displaying a flag supporting proscribed terror organisation Hezbollah at the O2 Forum in Kentish Town on 21 November 2024. The original case was thrown out in September when chief magistrate Paul Goldspring ruled the proceedings were instituted unlawfully. The CPS appealed this decision at the High Court in January, but two judges upheld the original ruling on Wednesday. The court determined that prosecutors failed to seek the Attorney General's permission before informing O hAnnaidh of charges on 21 May, with permission granted the following day, placing the charge outside the required six-month timeframe for bringing criminal charges.
