Judge Cameron McGowan Currie concluded that the prosecutor handling the matter was unlawfully appointed. Lindsey Halligan was named by President Trump as the interim U.S. attorney for the Eastern District of Virginia in September. The judge found Halligan lacked lawful authority to present the indictment against the former FBI director and the New York attorney general. Because the prosecutor had no lawful appointment, the indictments could not stand and the criminal cases were thrown out.
