'They have sole responsibility to care for individuals with serious life needs. They assist with bathing, with dressing, with toileting, with meals, with mobility. In essence, these workers are responsible for keeping these elderly folks alive and well.'"
Santa Clara County filed a lawsuit against Milpitas-based Safejourney Transport LLC (Happy Trip Home Care) and three individuals, alleging exploitation and labor law violations. The complaint alleges paying less than minimum wage, failing to pay overtime, and denying meal and rest breaks. Defendants reportedly hired immigrant workers for live-in 24/7 care of elderly clients, sometimes paying under $5 per hour compared with the $16.50 state minimum. The case followed a year-long investigation and names Armando Ogerio de Castro, Jr., Michelle Sison Delos Reyes, and Edmund Vasquez Olaso. County seeks an injunction and restitution for wage and identity theft.
