A motion to dismiss in the Mahmoud Sami Khan COVID fraud case describes that on May 22 prosecutors informed defense counsel that an attorney involved in the case engaged in conduct similar to that in the Broadview matter. The government disclosed that the same grand jury was used and planned, in an abundance of caution, to seek a superseding indictment and tender transcripts to the defense.

The government indicated it would tender all transcripts to defense counsel and that it, in an abundance of caution, planned to seek a superseding indictment in the matter to attempt to cure any potential taint associated with AUSA A's conduct"
