A federal judge dismissed the federal murder charge that would have permitted seeking the death penalty against Luigi Mangione in the killing of UnitedHealthcare CEO Brian Thompson. The judge found the charge technically flawed and expressly foreclosed the death penalty as an option for the jury. The judge also dismissed a separate gun charge while preserving stalking counts that carry a maximum sentence of life in prison. The court ruled stalking does not qualify as a "crime of violence" for capital-punishment purposes under applicable precedent. The court admitted evidence seized from Mangione's backpack, including a 9mm handgun and a notebook describing intent to "wack" an insurance executive. Prosecutors have 30 days to inform the court whether they will appeal the death-penalty ruling.
