Landlord ordered to pay 15,000 after refusing to accept HAP from tenant he later evicted
"A landlord has been ordered to pay the maximum €15,000 compensation after refusing to accept payments under the State housing assistance scheme on behalf of a tenant he later evicted into homelessness."
"The Workplace Relations Commission (WRC) has ordered the landlord, Sherman Chan, to pay his tenant Olga Burla the sum after ruling he had breached the Equal Status Act 2000 by discriminating against her on the grounds of housing assistance."
The Workplace Relations Commission ordered landlord Sherman Chan to pay tenant Olga Burla €15,000 after finding he breached the Equal Status Act 2000. Chan refused to accept payments under the State housing assistance scheme on behalf of Burla. The refusal to accept state housing assistance payments was found to constitute discrimination on the grounds of housing assistance. Chan subsequently evicted Burla, resulting in her homelessness. The WRC awarded the maximum statutory compensation to reflect the seriousness of the breach and the impact on the tenant. The Equal Status Act 2000 prohibits discrimination in accommodation on specified grounds, including receipt of housing assistance.
