Broward Circuit Court Judge David A. Haimes denied arbitration for disputes over more than 340 homes constructed by Lennar on Seminole land, while permitting arbitration for 123 homes sold to individual Tribe members. Tribe members sued Lennar alleging that hundreds of homes built over the last five years are in such shoddy condition that no one can safely live in them. The tribe's complaint seeks hundreds of millions of dollars in damages. Attorney William Scherer said the ruling allows immediate state-court proceedings and that discovery and depositions will proceed quickly. The tribe’s lawyers previously won a record judgment exceeding $800 million against Wells Fargo.
