"The fire broke out near the auditorium of the school on the afternoon of May 6, 2019 and was assumed to be out in the evening. It flared up again overnight when, according to the TDSB's claim, the site was left under the supervision of a school board security guard, who did not have the appropriate training to be on fire watch."
"But in a decision this July, Justice Loretta Merritt said the amended claim could now proceed because the school board is alleging the OFM went outside its scope of responsibility which interfered with the investigation. The Toronto Star was first to report on the decision, which came to light this week. The school board's claims have not been tested in court. The lawsuit is in preliminary stages and will be allowed to proceed on claims of negligence and negligent misrepresentation, according to the decision."
A provincial superior court ruled the Toronto District School Board can proceed with a lawsuit against the city, the police services board and Ontario's Office of the Fire Marshal over a 2019 fire that destroyed York Memorial Collegiate Institute. The board alleges the OFM neglected a duty of care, misrepresented its authority and interfered with Toronto Fire Services and Toronto Police Services investigations. The fire broke out May 6, 2019, was assumed extinguished, then flared overnight while supervised by an untrained security guard. The TDSB launched a $90 million suit in 2021. The amended claim proceeds on negligence and negligent misrepresentation and remains untested in court.
