Judge Paula Murphy was informed moments before the contested trial was scheduled to begin that the plaintiff's solicitor had received a last-minute text message from Charles Ward stating he was sick and unable to attend court. The barrister Eileen McAuley conveyed this information to the judge just as proceedings were about to commence.
