Charles Sean Dunn, a former Department of Justice criminal division assistant, hurled a sandwich at a Customs and Border Protection agent and fled. Dunn, 37, was arrested, charged with felony assault on a police officer, and later fired by Attorney General Pam Bondi. The U.S. Attorney for D.C. pursued a felony indictment and publicly vowed to back law enforcement. A D.C. grand jury declined to indict. Former DOJ official Mary McCord said clear video evidence exists but argued prosecutors overcharged the conduct, and grand jurors likely viewed the act as at most a misdemeanor.
I mean, we have a video, she noted. We can see exactly what happened. I'm not sure what else a grand jury would need. So, this says to me, this is a grand jury that is essentially nullifying. They're saying, You're presenting something here, and we either don't think it meets the elements of the crime, or even if it does, you are so overcharging, that we refuse to go for it.'
He thought it was funny. Well, he doesn't think it's funny today because we charged him with a felony assault on a police officer, and we're going to back the police to the hilt.
