The case alleged Musk was scammed out of an early investment when the nonprofit research lab shifted into a partial for-profit company. The verdict was unanimous, and the presiding US District Judge Yvonne Gonzalez Rogers accepted it quickly. Musk characterized the outcome as a calendar technicality and said the judge and jury did not rule on the merits. Musk stated he would appeal to the Ninth Circuit Court of Appeals. Musk also claimed Altman and Brockman enriched themselves by stealing a charity, while asserting the only issue was timing.
