A unanimous advisory jury reached a verdict after about two hours in Musk v. Altman in federal court in Oakland. Two claims were barred by the statute of limitations, and a third claim failed because it depended on one of the time-barred claims being viable. The jury’s findings are not legally binding because the jury is advisory and the judge retains ultimate authority. US District Judge Yvonne Gonzalez Rogers will issue the final decision. The case centers on allegations that OpenAI deviated from its founding mission and that Musk’s money was earmarked for a nonprofit. Musk alleges breaches of charitable trust and unjust enrichment, and also alleges Microsoft aided and abetted the breach.
