"On Saturday evening, Judge Colleen Kollar-Kotelly effectively sealed the evidence in the government's case against former FBI director James Comey. The ruling came in a suit filed by Daniel Richman, Comey's friend and sometimes lawyer, who demanded the return of files seized from him in 2019 and 2020 as part of the "Arctic Haze" investigation into the leak of national defense information."
"The legality of that search was hotly contested this year, with Magistrate Judge William Fitzpatrick assigned to adjudicate Comey's demand for discovery into the potential illegal search and exclusion of the Richman evidence. The case was dismissed before the motion was adjudicated, leaving the government free to keep looking at the documents without having to justify the search. For the time being, that's on hold, thanks to Judge Kollar-Kotelly's order."
Judge Colleen Kollar-Kotelly ordered the government to seal evidence seized from Daniel Richman during the 'Arctic Haze' investigation into a national defense leak. Richman sought return of files taken in 2019 and 2020 after the probe was closed without charges. The Justice Department reopened the stored material and used it to support a now-dismissed indictment of James Comey without obtaining a new warrant. Magistrate Judge William Fitzpatrick had been assigned to consider Comey's discovery request about the legality of the search, but the case was dismissed before adjudication. The court compelled the DOJ to appear and granted ex parte relief to Richman.
