A group of pediatric dental practices in North Carolina, led by Dr. David Thome, has sued former contractor James McGarvey for failing to relinquish control of web domains. Terminated for inadequate performance, McGarvey is alleged to have kept control of nine domain names despite being requested to transfer them. After an outage in October 2024, the practices discovered he still had access to their domains via HostGator, complicating their transition to a new IT vendor. The lawsuit claims the domains rightfully belong to the clinics, not McGarvey personally.
Defendants were independent contractors and registered and maintained the Domains on behalf of the NCPD Practices, not as personal assets.
McGarvey initially claimed he owned the domains as they were registered through his personal account, a situation the NCPD contests.
