The father, mother and brother of singer David Anthony Burke (known as D4vd) are challenging Los Angeles County grand jury subpoenas in Texas, arguing their due process rights are violated. A Texas appellate panel denied three habeas petitions to overturn a lower court order requiring the family to comply and testify in California, but the panel may rehear the matter on Feb. 24. The remains of 14-year-old Celeste Rivas Hernandez were found in a Hollywood tow yard in September; LAPD has not labeled the death a homicide though a detective filing described it as a murder investigation. Prosecutors have presented evidence to an investigative grand jury and called multiple witnesses; a friend who ignored a subpoena was arrested in Montana and compelled to return.
