Nacmias & Sons Auto Service LLC purchased a Sunoco gas station near Coney Island in a 2008 bulk sale that included the Sunoco lease and franchise agreement. The New York Tax Appeals Tribunal ruled the purchaser is responsible for $76,000 in outstanding New York sales tax that the seller failed to remit. The purchaser failed to notify the state tax department of the sale in time to avoid assuming the former owner's sales tax liabilities for 2006–2009. The tribunal released its opinion on Friday. Nacmias argued it was entitled to a refund, but the ruling assigned liability to the buyer.
