The Citizens' Law Enforcement Review Board (CLERB) in San Diego has faced challenges investigating serious injuries to youths in county custody due to confidentiality laws. Last week, it closed six cases involving juveniles, all of whom are now 18 and have sealed records. Advocates argue that the confidentiality laws should not prevent necessary oversight of law enforcement. Despite new powers granted to CLERB, obtaining reports from the Probation Department has been difficult, raising concerns about accountability in youth facilities following incidents of significant injuries.
"The goal is to provide a clean slate when they later apply for jobs, loans or housing."
"Too often, the confidentiality laws... are used to protect probation departments from accusations."
