Wisconsin has classified therapy marketed as “sexual orientation change efforts” for minors as unprofessional conduct for licensed counselors since 2024. The Wisconsin Institute for Law & Liberty and Wisconsin Family Action sued after a professional licensing board declined to rescind these standards following a U.S. Supreme Court ruling that struck down a Colorado ban on conversion therapy. The lawsuit argues the Wisconsin policy violates constitutional rights because counselors may provide such services as an exercise of faith to LGBTQ+ clients who voluntarily seek treatment related to sexual orientation or gender identity. The plaintiffs contend Wisconsin’s rule is materially indistinguishable from the Colorado law found to be viewpoint discriminatory. They also claim state officials refused to follow the Supreme Court holding and responded with rhetoric accusing them of bullying.
