"How strongly must we love knowing we are unconvicted felons under Section 377? My Lords, this is love that must be constitutionally recognized, and not just sexual acts."
"Menaka Guruswamy petitioned for and argued the landmark case decriminalizing same-sex relations in India in 2018. The ruling struck down Section 377 of the Indian Penal Code, which prohibited 'carnal intercourse against the order of nature.' The law was imposed on Indians during British colonial rule in 1861, and referred to homosexual sex as 'unnatural offenses.'"
Menaka Guruswamy, a senior advocate at India's Supreme Court, has been nominated to a seat in the Rajya Sabha, the country's upper house of Parliament. She is instrumental in India's 2018 landmark case that decriminalized same-sex relations by striking down Section 377 of the Indian Penal Code, a colonial-era law that criminalized homosexual conduct. If elected, Guruswamy will become the first openly LGBTQ+ member of India's Parliament. Nominated by the All India Trinamool Congress party from West Bengal, her nomination to the six-year term does not involve traditional political campaigning. Rajya Sabha members are elected by state legislative assemblies in biennial elections, similar to the former U.S. Senate system.
