Nearly 40 years ago, disability advocates negotiated with Republican lawmakers to pass the Americans with Disabilities Act, agreeing to exclude trans people from protections in exchange for Republican support. Recent federal court decisions under the Biden administration determined that many trans people qualify for disability law protections. The Trump administration now proposes reversing this progress. Disability rights advocates have shifted their historical position and now stand alongside LGBTQ+ organizations to extend civil rights protections broadly. This represents a significant change in disability advocacy strategy, emphasizing that civil rights laws should protect all people without excluding unpopular disabilities or conditions.
