A federal judge in Rhode Island has issued a temporary restraining order against the Trump administration's conditions on grants to organizations supporting domestic violence survivors, LGBTQ+ youth, and homeless individuals. The lawsuit, led by a coalition of organizations, targets restrictions placed by the administration that deny funding based on diversity and inclusion programs. Plaintiffs argue the executive branch overstepped its authority, as grants were authorized by Congress, asserting this move undermines the separation of powers. A proposal for the scope of the order is expected soon for court review.
The executive branch cannot unilaterally leverage funding Congress appropriated for use on programs Congress created to advance the executive's own policy goals.
The separation of powers does not allow that - and, here, Congress did not authorize the Departments to impose the new funding conditions.
