"The teachers won their case in a federal court in December, with George W. Bush-appointed Judge Roger Benitez ruling that California should 'trust parents to do the right thing for their child' and let teachers out trans kids to their parents, even in cases where the child fears abuse, neglect, or homelessness as a result. Trans and nonbinary youth are much more likely to experience homelessness compared to cisgender youth."
"Benitez also said that the district's policy violates the religious exercise rights of both teachers and parents, as well as parents' Fourteenth Amendment rights 'to care, guide, and make health care decisions for their children.' He compared a child being transgender to being sexually victimized, arguing that a teacher would have to report abuse and that this is the same thing as outing trans kids."
Several conservative Christian teachers and four parents from Escondido Union School District seek Supreme Court intervention to immediately inform parents when students are transgender, challenging a district policy that bans outing students. The plaintiffs claim the policy forces them to violate their religious beliefs and infringes parents' Fourteenth Amendment rights to direct health care and upbringing decisions. A federal judge, Roger Benitez, ruled for the teachers and issued a permanent injunction, arguing for parental trust even when youths fear abuse or homelessness. The Ninth Circuit stayed that injunction, allowing California to continue enforcing its anti-outing guidance.
