The military junta that seized power in 2022 has criminalised homosexuality, instituting prison sentences of two to five years and fines. A transitional parliament of 71 unelected members adopted the draft law as part of wider family and citizenship reforms. Justice Minister Edasso Rodrigue Bayala said perpetrators would face judges and that foreign nationals could be deported. Homosexuality had not been illegal in Burkina Faso before the junta moved to criminalise it in late 2024. The change aligns with a regional pattern of anti-LGBT legislation in several African countries, while some states advance trans rights.
