Tokyo's High Court ruled that Japan's ban on same-sex marriage does not violate Article 24(1) and (2) or Article 14(1) of the Constitution. The court held that a unit between a heterosexual couple and their children is a rational legal definition of a family and found the exclusion of same-sex marriage valid. The court dismissed claims for one million yen in damages sought by each of the couples. This ruling is the final decision among six high court lawsuits filed between 2019 and 2021 in cities including Tokyo, Osaka and Sapporo. A Supreme Court ruling is expected next. Plaintiffs expressed outrage and disappointment, and Amnesty International criticised the decision as effectively permitting discrimination against LGBTQ+ couples. Japan remains the only G7 country without equal marriage recognition.
