Forest Lawn sues builder at former El Toro Marine base
"Forest Lawn has spent hundreds of thousands of dollars in architectural, design and engineering costs and worked with Lennar to obtain city approvals to build the memorial park. Forest Lawn attorney David Waite said Lennar had for some time been trying to "unwind and frustrate the agreement" by moving the proposed site and demanding Forest Lawn sign away its rights to develop the property."
"Forest Lawn said in a news release that the city of Irvine had identified the need for a cemetery on the former base and that the site has "special significance to World War II veterans who were stationed at El Toro." On Tuesday, the Irvine City Council voted to authorize its corps of designers to study the construction of a cemetery and military memorial of its own at the future Great Park."
Forest Lawn filed a lawsuit against Lennar Corp. for allegedly violating a 2004 written agreement to develop a memorial park, cemetery, and mortuary on 73 acres of the former El Toro Marine base in Irvine. Forest Lawn claims it invested hundreds of thousands of dollars in architectural, design, and engineering costs while working with Lennar to obtain city approvals. Lennar executives reportedly told Forest Lawn last month they had "moved on" from the plan. Forest Lawn's attorney states Lennar has been attempting to "unwind and frustrate the agreement" by relocating the proposed site and demanding Forest Lawn relinquish development rights. The city of Irvine identified the cemetery need and noted the site's significance to World War II veterans. Irvine's city council subsequently voted to study constructing its own cemetery and military memorial at the future Great Park.
