Nintendo also claimed the site would return Switches with pirated games pre-installed. Back in March 2024, Nintendo threatened to sue Daly over the site, and the two parties agreed that Daly would stop his naughty behavior and the whole thing would go away."

Rather than rush to settle, the entrepreneur instead opted to respond to the complaint denying all wrongdoing, and even more wildly, did this without the advice of any lawyers. He even denied being responsible for the Modded Hardware business, but then given how blatant the site was about its actions, he'd have to. As reported by TorrentFreak, Daly's legal response wasn't exactly stunning legal work."
Nintendo pursued legal action against Ryan Daly after he operated Modded Hardware, which sold modded Nintendo Switch consoles capable of installing homebrew and pirated games and sold the tools enabling others to do the same. Nintendo alleged some returned units contained pirated games preinstalled. Initial March 2024 negotiations produced an agreement for Daly to stop, but Daly continued operations and prompted a June court filing. Daly represented himself, filed terse denials and asserted affirmative defenses including fair use and an 'unclean hands' claim. The matter concluded with Daly settling for $2 million and agreeing to cease modding permanently.
